2008 2009 IRS W2 Deadline Date for Employer W2 Tax Form

As an employer, its extremely impotant that you start filing W2 forms with IRS from as ealy as February to ensure you don't miss the deadline for W2 Forms.

Who must file Form W-2. Employers must file Form W-2 for wages paid to each employee from whom:

- Income, social security, or Medicare tax was withheld or

-Income tax would have been withheld if the employee had claimed no more than one withholding allowance or had not claimed exemption from withholding on Form W-4, Employee's Withholding Allowance Certificate.

Also, its important that every employer engaged in a trade or business who pays remuneration for services performed by an employee, including noncash payments, must file a Form W-2 for each employee even if the employee is related to the employer.

The official deadline for W 2 form is March 2, 2009 for Paper W2 Form. If you are using electronic filing for w2 then the deadline is 31st March 2009. This is the official filing deadline with IRS. However you must note that
even if you request an extension to file Form W-2, you must still furnish Form W-2 to your employees by February 2, 2009 (which is over overdue by now).

Please note that there are w2 deadline penalties related to overdue of W2 form filing.

The W2 Deadline Overdue penalty is:

$15 per Form W-2 if you correctly file within 30 days; maximum penalty $75,000 per year ($25,000 for small businesses, defined later).

$30 per Form W-2 if you correctly file more than 30 days after the due date but by August 3; maximum penalty $150,000 per year ($50,000 for small businesses).

$50 per Form W-2 if you file after August 3 or you do not file required Forms W-2; maximum penalty $250,000 per year ($100,000 for small businesses).


You can download latest W2 form from IRS. As an individual you would have to file your taxes by April 15th 2009, you must check out the latest IRS Tax Tables for 2009

I am an independent contractor and the company who I am no longer associated with has not mailed me my 2009 - 1099 form. Is there a deadline date in which the company has to provide me with my 1099 and is it mandatory for me to attach the 1099 in the event I do not receive the form? I do have all of the stubs for all income received and was wondering if I would be able to attach the stubs without the 1099 form when filing my taxes.

My ex-employer says they mailed the 2009 w2's out over 2 weeks ago. I still have not recieved them and the ex-employer says they have not had anything returned to them. Is there anything I can do to get copies of them from somewhere??? Any information will be appreciated oh and I have tried the IRS office and they said they dont have them yet.

I was released from my job Jan. 16th 2009 and although other employees still there have recieved their w-2"s I have not I have called and have gotten the run around saying it's lost, it's in the mail it hasn't been returned etc... I have asked for duplicates and have gotten no where! Who do I go to to get my w-2 since this company is not being forthright?

She should be able to do this for you by doing it online or using a e-file service herself. It's easy as long as you don't have a lot of deductions.She will need to read everything and fill out only what's needed. I use taxslayer.com it's easy. Anything that you have to sign she can mail to you and you will be able to send it back to her for her to mail.

My employer said they mailed out the W2 forms on January 28 2009. I still have not received my W2 yet. The company now tells me they will not send me another w2 form until the one they sent out comes back to them. They then told me at the end of the month I can request the employers copy of my W2. They said they will do nothing until then. I have reported them to the IRS and I told my company. They said they don't care what the IRS says they are going by their procedure. She also hung up on me saying that I was taking to her about legal information and she did not have to listen to me. I feel that they are being mean to me because I am a terminated employee. I feel that since I collect unemployent from the company since they wrongfully fired me. they are trying to get back at me. I do not knoe what to do.

Here is what you do: Issue Number: TT-2009-28 Inside This Issue What to Do If You Are Missing a W-2 Did you get your W-2? These documents are essential to filling out most individual tax returns. You should receive a Form W-2, Wage and Tax Statement, from each of your employers each year. Employers have until February 2, 2009 to provide or send you a 2008 W-2 earnings statement either electronically or in paper form. If you haven’t received your W-2, follow these steps: 1. Contact your employer. If you have not received your Form W-2, contact your employer to inquire if and when the W-2 was mailed. If it was mailed, it may have been returned to the employer because of an incorrect or incomplete address. After contacting the employer, allow a reasonable amount of time for them to resend or to issue the W-2. 2. Contact the IRS. If you still do not receive your W-2 by February 17th, contact the IRS for assistance at 800-829-1040. When you call, have the following information: Employer's name, address, city, and state, including zip code; Your name, address, city and state, including zip code, and Social Security number; and An estimate of the wages you earned, the federal income tax withheld, and the period you worked for that employer. The estimate should be based on year-to-date information from your final pay stub or leave-and-earnings statement, if possible. 3. File your return.
