NYS still has not sent me my refund for 2008.

It's been over 100 days since I filed and requested my refund from NYS. I even spoke to someone at NYS Income tax office and they said that yes everything was received and there is no problem with my tax form. The representative said it probably got tied up with other peoples returns. What gives ?
